So, if I understand the above, 2 ore-thieves who form a gang (one in a BS, the other in hauler) and steal from a can will be flagged as thieves, allowing the miner/gang/corp to fire at both (or either) of them. But, only the ore thief who is fired upon can shoot back?
If that's the case, then it puts a stopper in all of the arguments some of the thief-punks have been using about this feature being used to gank miners or lure them into traps.

That's simple enough. If the can doesn't say [CDSV] on it, I cant remove anything from it. I cant even open it to see what's inside. I'd have to (oh no!) train a skill and use a cargo scanner on the can if I really wanted to know what was in it.
I agree but, as more than a few have pointed out, thieving is a viable (and oft-travelled) profession-path in EVE. Your example of a solution, while perfectly workable, would put a complete and total end to thieving, thereby removing a potentially enjoyable (though morally distasteful) career path for many players.
